Employer of Record in Georgia (the Country) — Hire Tech Talent Without a Georgian Entity

Georgia here means the South Caucasus country — capital Tbilisi, not the US state. Georgia's IT sector employs approximately 40,000 people, growing 15–20% annually. Employer social contributions: 0% — identical to Armenia. Timezone: UTC+4, giving 7 hours daily overlap with Berlin. EU Association Agreement in force since 2016.

After the 2022 Russian IT relocation wave, Tbilisi now has one of the densest concentrations of experienced developers outside Russia itself. NexoStaff operates EOR in Georgia. Here's what the compliance structure looks like and what you'll pay.

Why Georgia's PE Threshold Requires Different Thinking

In Armenia, Kazakhstan, and Azerbaijan, PE threshold is a fixed day count (183 days, or 90 for Azerbaijan). Georgia is different. Georgia's PE test is substance-based, under Tax Code Article 29. There is no calendar-day threshold. PE is triggered when: (1) A foreign company conducts management activities in Georgia — signing contracts, generating revenue attributable to Georgian operations, or making strategic decisions. (2) A dependent agent in Georgia has authority to conclude contracts on the foreign company's behalf.

For a pure engineering developer who writes code, has no authority to sign contracts on behalf of the European company, and does not represent the European company commercially — the management PE risk is low. Under NexoStaff EOR structure, the developer is not your employee and has no authority to act as your agent. PE risk is removed at the structural level.

The Post-2022 Talent Pool

After February 2022, an estimated 50,000–80,000 Russian citizens entered Georgia. A large proportion — 20,000–30,000 — were IT professionals. By 2025, approximately 60–70% have moved on. Those who stayed make up a meaningful share of Tbilisi's IT workforce today.

Compliance: citizenship vs residency

The compliance question is residency and sanctions status, not citizenship. NexoStaff screens every developer against EU Consolidated Sanctions List, OFAC SDN List, and UN Consolidated List. Russian citizenship is not itself a sanctions basis. Individual SDN list membership is.
